and use of the Twish Cart platform (the “Platform”) provided by Twish Technologies Inc.

1. Platform Description
Twish Cart is a collaborative platform that enables users (“Members”) to pool their
grocery purchases, access exclusive deals, and benefit from group buying power, with
fulfillment, payment, and delivery services managed by Twish and its partners.
2. Eligibility and Account Registration
• You must be at least 18 years old or have legal parental/guardian consent to use
Twish Cart.
• You agree to provide accurate, current, and complete information when
registering for an account.
• You are responsible for maintaining the confidentiality of your account
credentials.
3. User Conduct
By using Twish Cart, you agree to:
• Use the platform only for lawful purposes.
• Refrain from impersonating any person or entity, or misrepresenting your
affiliation with a person or entity.
• Not use the Platform to harass, abuse, defame, or threaten others.
• Not engage in fraudulent, misleading, or deceptive practices.
• Not interfere with or disrupt the operation of the Platform or the

4. Ordering, Payment, and Group Buying
• Orders placed via Twish Cart are pooled and fulfilled based on participation and
availability.
• Prices are based on negotiated group rates; these may fluctuate depending on
supplier availability.
• You authorize Twish Cart to charge your selected payment method for the total
amount of your order, including taxes, service fees, and delivery charges where
applicable.
• If minimum group order thresholds are not met, orders may be delayed,
canceled, or rescheduled at Twish’s discretion.
5. Delivery and Pickup
• Delivery and/or pickup times are estimates and subject to change based on
supplier, weather, and logistical constraints.
• Users are responsible for providing accurate delivery addresses and being
available to receive orders.
• Twish Cart is not liable for delays or issues caused by incorrect information,
absence at delivery, or force majeure events.
6. Returns, Refunds, and Order Issues
• Perishable and non–perishable products are subject to different return and

• Issues with orders (missing, incorrect, or damaged items) must be reported

8. Intellectual Property
• All content, trademarks, logos, and software on the Platform are the property of
Twish Technologies Inc. or its licensors and protected by copyright laws.
• You may not copy, modify, distribute, sell, or lease any part of our Platform or
included software.
9. Privacy and Data Protection

how we collect, use, and protect your personal information.

10. Limitation of Liability
• Twish Cart is provided “as is” and “as available” without warranties of any kind.
• To the fullest extent permitted by law, Twish Technologies Inc. is not liable for
any direct, indirect, incidental, consequential, or punitive damages arising from
or related to your use of the Platform.
11. Termination
• Twish Cart reserves the right to suspend or terminate your account and access to
the Platform at any time, with or without notice, for violation of these Terms or
for any other reason deemed necessary.

12. Modification of Terms
• Twish Cart may modify these Terms at any time. Updates will be posted on the
Platform with a new effective date. Your continued use of the Platform after such
changes constitutes acceptance.

• These Terms are governed by and construed in accordance with the laws of the
Province of Ontario, Canada, without regard to its conflict of laws provisions.
